TERMS AND CONDITION
IMPORTANT NOTICE
When placing an order you have made an agreement that the terms and conditions below apply from the time that One Roof Autos Japan Inc.
ships your purchase unless otherwise agreed in writing by an authorized staff member of One Roof Autos Japan Inc.
1. Roll on Roll off (RORO)
When your order is loaded onto the ship via RORO it is ensured to function properly and should be free of mechanical deficiency.
2. INSPECTION
In the case that local authorities require an inspection to per partaken in Japan, this will be arranged by One Roof Autos Japan Inc. If the customer chooses to waive or forgo the inspection One Roof Autos Japan Inc. shall not be responsible for any claims made thereof.
3. Shipment
Once payment is confirmed, One Roof Autos Japan Inc. will proceed to book your unit for shipping. Estimated departure and arrival times as well as routes of ships may change without notice. One Roof Autos Japan Inc. is not responsible for these changes. Futhermore, One Roof Autos Japan Inc. is not liable for loss or damage to any units beyond its control such as fire, natural disasters, acts of God, riots, sabotage, insurrection/war or government law, stature or ordinance.
4 Container
Units can be shipped by container depending on the port and country of destination.
5. Copyright and Trademark
Any information on One Roof Autos Japan Inc.’s website or information on One Roof Autos Japan Inc. company documents is property of One Roof Autos Japan Inc. and may not be used without the consent of an authorized agent. Any such information may not be used, reproduced or modified is prohibited without permission. Violators will be liable.
6. Claims
One Roof Autos Japan Inc. will consider claims only pertaining to mechanical issues. Any claims must be corroborated by evidence, such as pictures, video, receipts and inspection sheets from the port authority. Upon receiving the necessary evidence, One Roof Autos Japan Inc. will respond within 21 business days. Any such claims must come directly from the agent of purchase who has negotiated with One Roof Autos Japan Inc. One Roof Autos Japan Inc. will not respond to third-party claims.
7. Time Limit for Claims
All claims must be submitted within 5 business days after collection of the unit or units. Tardy claims will not be considered.
8. Internet
One Roof Autos Japan Inc. is not liable for loss or damage that might occur as a result of the delay, interruption or suspension of internet services which it depends on to engage in the sale of units.
9. Loss or Damage
During Shipment One Roof Autos Japan Inc. is not liable for damage, theft or loss of items or parts during transportation to the port of destination.
10. Other Services
One Roof Autos Japan Inc. maybe able to aid in introducing clearing and forwarding services upon a customer’s request. One Roof Autos Japan Inc. is not responsible for undertaking these services. Any agreement is exclusive to the customer and clearing-and-forwarding agent. Therefore, any claim in regarding the service of clearing or forwarding shall not be between One Roof Autos Japan Inc., but between the customer and the agent.
11. Invoices Payments
for automobiles from One Roof Autos Japan Inc. must be made by telegraphic transfer (TT) to the Japanese bank account specifically designated by authorized One Roof Autos Japan Inc. staff. In order to avoid fraud, the customer must verify the account number by contacting there designated One Roof Autos Japan sales agent.
12. Part Payment and Due Balances
Outstanding balances must be paid within 15 calendar days after the vessel departs the port of origin. Failure to complete the balances entitles One Roof Autos Japan Inc. to re-sell the unit(s) without prior notice. In the case of illness, demise or inability to complete the balance of due payment, the above does not apply to customers with referral contact person who completes the balance. However, the alternate person must provide proof the extenuating circumstances. One Roof Autos Japan Inc. reserves the right to withhold original copies of the B/L or other documents until the final payments have been confirmed in our account. In the event a customer makes a 50% payment and fails to pay the remaining balance in timely manner, One Roof Autos Japan Inc. will not refund any portion of the payment as it will be considered as a cancellation fee to cover expense incurred by One Roof Autos Japan Inc. and/or the shipping company. Any further costs incurred by One Roof Autos Japan from the time that partial payment was effected unit the clearing of the due balance shall be recovered by One Roof Autos Japan Inc. from the customer.
13. Fees Re-sold
units are sold “as-is.” In the event of a customer purchasing a re-sold unit “as-is” that has already arrived in the port of destination, the customer must pay any demurrage fees, local fees or consignee name amendment fees that may apply. Any additional costs that may arise in order to gain possession of the unit must be incurred by the customer.
14. Severability
The invalidity or unenforceability of any provision herein shall not affect any other part of these Terms and Conditions.
15. Governing Law
Any dispute concerning the terms and conditions fall under the exclusive jurisdiction of the courts and laws of the government of Japan and the customer agrees to submit to this jurisdiction.
16. Indemnity
The customer agrees to indemnify Autocom Japan The customer agrees to indemnify One Roof Autos Japan Inc. from any claim or action that may arise as a result of the customer making other agreements based on the transaction between One Roof Autos Japan Inc. and the customer. The customer further agrees to indemnify One Roof Autos Japan Inc. against any claims or actions resulting from the customer failing to comply with local laws or regulations of the country or port of destination.
17. Validity of Agreement
This agreement is valid until the completion of the balance of the negotiated price.
18. Amendment
One Roof Autos Japan Inc. may amend these terms and conditions should the need arise and the customer shall be remain bound the revised terms and condition if a revision takes place. 19. Import Regulations and Tariffs One Roof Autos Japan Inc. is not responsible for any action pertaining to tariffs of imported vehicles
